You may be eligible for relief from removal if:

  • You fear political, religious, ethnic or other forms of persecution and are seeking asylum.
  • You have no criminal charges against you and can prove hardship to a qualifying U.S. citizen relative.
  • You have family in the United States.
  • You are a victim of domestic violence (Violence Against Women Act, also known as VAWA).

In filing an application, we may seek a cancellation of removal if have been a legal permanent resident for at least five years and:
  • Were legally admitted to the United States
  • Have lived in the U.S. continuously for at least seven years (that is, you did not leave for a period of time and then reenter the U.S.)
  • Have not been convicted of a felony
  • Or if convicted of a crime, you can receive waivers

Cancellation of removal for those here on a nonimmigrant visa (no green card) may be granted if you:
  • Have a qualifying relative in the U.S.
  • Have lived in the U.S. continuously for at least 10 years (did not leave for a period of time and then reenter the U.S.)
  • Have demonstrated "good moral character"
  • Can prove that deportation would create a hardship for your spouse, parents or children
